Senators Introduce Bipartisan Legislation to Repeal Medical Device Tax

On Thursday, Sens. Pat Toomey (R-PA) and Amy Klobuchar (D-MN) introduced a bill that would repeal the Affordable Care Act’s (ACA) 2.3% excise tax on medical devices. The new bill, S. 692, the “Protect Medical Innovation Act of 2019,” has 24 additional bipartisan sponsors and would eliminate the ACA tax that already has been delayed twice. Thanks in part to ASCRS advocacy, the medical device tax is not scheduled to take effect until January 2021.

A similar device tax bill passed the House during the last Congress but stalled in the Senate.
